American Campus Communities Oregon Bureau of Labor and Industries Prevailing Wage Investigation
We are representing America Campus Communities in an investigation by the Wage and Hour Division of the Oregon Bureau of Labor and Industries (BOLI) concerning prevailing wages that were allegedly not paid to employees in connection with the construction of student residences on the campus of Southern Oregon University in Ashland, Oregon. This development was a 27+ million dollar project the involved over 60 contractors and hundreds of employees. We have prepared presentations to BOLI concerning legal and factual issues relating to noncoverage of the project under the Oregon prevailing wage laws, and the appropriateness of applying residential wage rates to the project, if it is found to be covered by Oregon prevailing wage laws. The current claim by BOLI is wages of $2.3M plus liquidated damages of $2.3M.
