Maximizing Lender Recovery and Minimizing Risk on Condominium and Residential Projects Held as Collateral or REO

Financial institutions and other institutional lenders are in the midst of a prolonged process of foreclosing, acquiring and subsequently liquidating a variety of residential projects, including unfinished condominium and single-family developments at various stages of the entitlement process. These often-troubled assets pose unique challenges and risks to lenders. Those risks include permitting and entitlement difficulties, access problems, HOA assessments and compliance, condo defect and marketing liability, priority disputes, and a multitude of other unique issues.
