Court Rejects Challenge to Northwest Biotherapeutics’ Arbitration Victory
After Lane Powell client, Northwest Biotherapeutics, won an arbitration in a dispute over an investment banking fee, the opposing party appealed the arbitrator’s decision to New York state court. In the appeal, the opposing party claimed that the arbitrator had an undisclosed conflict of interest, and that the arbitrator’s decision was arbitrary and unsupported. After extensive briefing, the New York court denied the investment banking firm’s appeal and confirmed the original decision in favor of Northwest Biotherapeutics.
