United States Supreme Court Rejects “Reverse” Age Discrimination Claim

In General Dynamics Land Systems, Inc. v. Cline (U.S. Supreme Court, February 24, 2004), the United States Supreme Court rejected plaintiffs’ claim that the Age Discrimination in Employment Act (ADEA) is violated when “reverse” age discrimination favors older workers over a group of younger workers — even though the younger workers are at least 40 years old.
