United States Supreme Court Upholds EEOC

In Chevron USA, Inc. v. Echazabal (June 10, 2002), the United States Supreme Court unanimously ruled that employers may refuse to hire an applicant for a position when that position poses a direct threat to the applicant’s health or safety without violating the Americans With Disabilities Act (“ADA”).
