Internet Copyright Case Finds
In a further application of copyright law to the Internet, a federal court of appeals recently ruled in Kelly v. Arriba Soft Corp. that the “visual” Internet search engine Ditto.com infringed a photographer’s copyrights by linking to and framing full-sized copies of his images. Nevertheless, applying the “fair use” exception to copyright infringement, the court ruled that the display of small “thumbnail” size copies of the images without permission was not infringing.
