Battles and Ostroff to Present at WHCA Fall Conference (Yakima, Wash.)
Lane Powell attorneys Bob Battles and Paul Ostroff will present at the Washington Health Care Association (“WHCA”) Fall Conference on September 27 in Yakima, Wash.
Battles will present “Preparing for OSHA/DOSH National Emphasis on Nursing Homes: Are you Ready to Go Under the Microscope?” In his presentation, Battles will focus on the Occupational Safety and Health Administration (“OSHA”) and Washington State Division of Occupational Safety and Health’s (“DOSH”) emphasis on the nursing facility industry. It will include a discussion of OSHA’s site-specific targeting program and OSHA/DOSH’s expected Nursing Home National Emphasis Program (“NEP”), which specifically targets nursing homes with a goal to minimize and/or mitigate workplace injuries and illnesses.
Ostroff will present “The New Climate for Unionization in the Health Care Industry — What Employers Can and Should Do to Maintain a Union Free Workplace.” In the presentation, Ostroff will review recent and proposed changes in National Labor Relations Board policy, how these changes will affect employers in the health care industry, and the steps employers should be taking now to successfully prevent union organizing campaigns. He will discuss a number of measures employers should consider to achieve these objectives, including the role of internal employee committees; lawful restrictions on union solicitation; open door and in-house dispute resolution systems; how to ensure that supervisory personnel retain their supervisory status, and remain part of the management team; effective and lawful employee communications; lawful strategies to prevent union’s from infiltrating the workforce through the use of “salts”; and employer policies and handbook provisions that advance management’s objectives in this area.
