Claman Discusses Success of Preliminary Injunction for Lane Powell Client A-1 Timber Consultants on KMXT Radio
Lane Powell Counsel to the Firm Matt Claman was interviewed on KMXT Public Radio on June 8 in the segment “A-1 Timber Could Resume Chiniak Logging by Next Week.” While on KMXT, Claman discussed Lane Powell’s successful motion for a preliminary injunction in the case of A-1 Timber Consultants, Inc. (“A-1”) v. Leisnoi, Inc. Lane Powell client A-1 was granted a preliminary injunction June 3, allowing them back on Leisnoi Native Corporation land to resume logging after Leisnoi halted operations six months ago. A-1 has a four-year contract with Leisnoi to harvest 100-million board feet of timber from the Native Corporation’s land in Chiniak. However, Leisnoi ordered A-1 off the land in December 2010, claiming that the company was not complying with certain insurance and escrow requirements. Claman disputed Leisnoi’s claims in the radio segment:
One of the issues that Leisnoi complained about was they suggested that the escrow account needed to be replenished immediately whenever withdrawals were made from the escrow account, and A-1 has always insisted that it should be applied in a commercially-reasonable way. The judge ordered that A-1 has seven days to replace the escrow account when withdrawals are made from the escrow account. Seven days is exactly what A-1 had proposed for months. Leisnoi made complaints about insurance requirements. By the time Leisnoi suspended operations, A-1 was in full compliance of all the insurance requests made by Leisnoi.
