Hosenpud Quoted in Portland Business Journal Regarding Wage and Hour Laws
Lane Powell Shareholder David Hosenpud was quoted in the Portland Business Journal (“PBJ”) on November 12, in an article titled “Restaurants, Contractors Struggle with Wage Laws.” The article discusses industries in Oregon that often receive wage and hour violations, which involve failure to pay for overtime, failure to pay at proper rates and failure to keep adequate records.
Typical scenarios for such claims include supervisors telling hourly employees — or permitting them — to work during lunch, or to start working before their shift begins, or to keep working after the shift ends.
If an employee doesn’t have time to punch in correctly, or if an automated wage system doesn’t take into account some work on the lunch hour, claims arise, Hosenpud said.
Employers should periodically audit their systems to ensure that such overtime situations are recorded properly, he said.
