Ken Davis, a Lane Powell shareholder who specializes in intellectual property, was quoted on Forbes.com on Saturday, April 19, about intellectual property disputes involving high-profile apparel companies, including Victoria’s Secret, Phat Fashions, Macy’s and Target.
Davis said that the line between imitating general design elements and copying trademarks is very blurred. The more people who sue, the more complicated it gets. “There’s a risk that overprotection of brand elements will decrease consumer choice,” he said. “You want to protect your brand, but you also want to encourage competition.”
