Supreme Court Rules That “Constructive Discharge” Can Be “Tangible Employment Action In Title VII Cases

In a case with some bad news and some good news for employers, Pennsylvania State Police v. Suders (U.S. Supreme Court, June 14, 2004), the United States Supreme Court held that:

  • Plaintiffs may quit their jobs, claim “constructive discharge” and sue their employers under Title VII; and
  • Under certain conditions in Title VII constructive discharge cases, an employer may assert the Ellerth/Faragher affirmative defense. View full article (PDF).
