Maximizing Lender Recovery and Minimizing Risk on Condominium and Residential Projects Held as Collateral or REO

Financial institutions and other institutional lenders are in the midst of a prolonged process of foreclosing, acquiring and subsequently liquidating a variety of residential projects, including unfinished condominium and single-family developments at various stages of the entitlement process. These often-troubled assets pose unique challenges and risks to lenders. Those risks include permitting and entitlement difficulties, access problems, HOA assessments and compliance, condo defect and marketing liability, priority disputes and a multitude of other unique issues.

Please join our panel of Lane Powell attorneys, along with our guest speaker from Propel Insurance, on Tuesday, September 21, as they address the risks and issues lenders face when enforcing and holding residential development and condominium collateral, and methods to minimize those risks and maximize recoveries.
