CMS Provides Sample “Under Arrangement” Contracts for SNFs
Recently, the Centers for Medicare and Medicaid Services (CMS) issued sample contracts regarding the arrangement between a Skilled Nursing Facility (SNF) and a supplier for services subject to consolidated billing. Under previous guidelines, SNFs were allowed to enter into an arrangement as long as the arrangement specified the services that were supplied and how the SNF paid the supplier for these services. These guidelines remain in place. The recently issued sample contracts are not a CMS requirement. Rather, the arrangement can be entered into through a formal contract or other kinds of documents. CMS does not require SNFs, suppliers, and practitioners to use these sample documents or follow their exact language. Rather, CMS is providing these documents to offer direction.
