Feeding Assistants Class Action
To address the critical shortage of certified nursing assistants, the Department of Health and Human Services, Centers for Medicare and Medicaid Services promulgated regulations effective 2003 that permit long-term care facilities to use paid feeding assistants to supplement services of certified nurses aides. Controversial at their inception, the regulations are now under official attack in the Residents Council of Washington et al. v. Thompson case, which was filed in the United States District Court for the Western District of Washington on July 30, 2004.
