Prevailing Plaintiffs May Obtain Additional Recovery to Offset Adverse Tax Consequences Resulting From Damage Awards Under the Washington Law Against Discrimination

In Blaney v. International Ass’n of Machinists, (Washington Supreme Court, April 1, 2004), the Washington Supreme Court held that, in addition to other remedies, a prevailing plaintiff may also recover a monetary amount sufficient to offset the adverse tax consequences associated with an award of damages under the Washington Law Against Discrimination (“WLAD”).
