Defending Health Care Fraud and Abuse

This article reviews substantive health care fraud law, strategies from a provider’s perspective and practice pointers for lawyers who are not normally involved in criminal cases. It addresses recent developments in health care fraud investigations, responding to a subpoena, what to do if the government “comes knocking” at your door, internal audits and investigations, the grand jury process, negotiating a resolution when billing irregularities are identified, voluntary self-disclosure and corporate integrity agreements. Criminal defenses are covered, as they pertain to fraud and abuse prosecutions.
