Prayers Answered: RLUIPA Constitutionality Upheld

In what appears to be the first federal case decided addressing the Constitutionality of the Religious Land Use and Institutionalized Persons Act (RLUIPA), U.S. District Judge Stewart Dalzell in the Eastern District of Pennsylvania, upheld RLUIPA on Constitutional grounds. The opinion in Freedom Baptist Church of Delaware County v. Township of Middletown, et al., No. 01-5345, (May 8, 2002), appears to have ended the speculation, at least for now, that RLUIPA will suffer the same fate as the Religious Freedom and Restoration Act (RFRA).
