Washington Supreme Court Holds That Washington’s Anti-Spam Laws Pass Constitutional Muster

On June 7, 2001, the Supreme Court of the State of Washington held that Washington’s Commercial Electronic Mail Act (the “Act”), which prohibits misrepresentations in the subject line or transmission path of commercial e-mail messages, did not violate the dormant commerce clause of the United States Constitution.
