Lane Powell’s Land Use Practice Group represents both public and private sector clients and focuses on a wide range of policy and regulatory issues at the federal, state and local level, including wetlands, shorelines, water rights, natural resources, and comprehensive planning and zoning, including state and local issues arising under the Washington Growth Management Act and Oregon’s statewide land use planning program.
Lawyers in our Land Use Practice Group represent both public and private sector clients, including counties and municipalities, property owners, developers, and individual proponents of development and redevelopment projects throughout the region. Representative projects cover a broad spectrum, from urban mixed-use redevelopment to suburban centers, from retail complexes to residential subdivisions and multi-family villages, from natural resource extraction to recreational resorts, retirement and senior communities, and all types of office, commercial, residential and industrial developments.
In the course of our practice, we regularly advise and represent clients on assessing property for development, and assisting in the preparation and pursuit of those permits and approvals that may be required. Our land use lawyers have assisted clients throughout the development process, at public meetings and hearings before state and governmental bodies and regulatory agencies; in the preparation of decision-making documents; in assessing governmental authority to condition projects, whether those conditions include the payment of impact fees or modification of project specifications; in the formation and negotiation of mitigation programs; and when necessary, representation in litigation, including appeals, regarding the propriety of the governmental action.
