The Labor and Employment Practice Group represents management in the entire range of labor and employment matters and issues. We serve clients in virtually every industry and handle labor and employment matters in both the private and public sector in the following broad areas:
Labor Law
- Union organizing including advice, training, campaigns, ERB/PERC proceedings
- Collective bargaining including advice, drafting, negotiations, ERB/PERC proceedings
- Unfair labor practices including defending and litigating ULP claims before the National Labor Relations Board and the courts
- Labor arbitration and mediation including advice and training in grievance avoidance and resolution
Employment Discrimination
- Complaints before the EEOC, OFCCP and other state and federal agencies
- Litigation and alternative dispute resolution (for example, mediation of employment disputes)
- Defense of Title VII, ADA, ADEA, FMLA, COBRA and other claims under federal and state law
Employment Law
- General personnel advice including compliance with all federal and state EEO laws
- Employment contracts and employee handbooks including drafting, advice and enforcement
- Non-competition agreements including drafting, enforcement and defense of non-competition covenants
- Wage and hour matters including defense before administrative agencies and state and federal courts
- ERISA including drafting of ERISA plans and defense of claims before federal and state courts
- OSHA/WISHA/OR-OSHA including advice and defense of citations before the OSHRC, Washington Board of Industrial Insurance Appeals and the Oregon OSHAB
We place great emphasis on providing advice and training in an efficient and cost-effective manner. For example, we offer seminars on a variety of topics of general interest, as well as a number of smaller programs specially tailored to the needs of clients or groups of clients. We regularly publish and produce The Employer Adviser hotsheet and The Pocket Adviser series.
We also offer a video and online training series on employer rights and responsibilities in the areas of:
- Successful termination
- Preventing sexual harassment (employers and employees)
