Patent Team Takes Our Client From Patents to Market

Lane Powell recently received a patent (US 8/512,221, Automated Treatment for Sleep, to be issued August 20) for Firm client Consolidated Research Inc. of Ohio. Lane Powell Counsel to the Firm Priya Cloutier has worked with Consolidated Research since 2008, and has been successful in helping the company obtain multiple frontier patents in the U.S. and overseas. The recently issued patent relates to a medical device and method for treating insomnia and improving sleep hygiene. The medical device has the potential to revolutionize how individuals are treated for sleep disorders. In the past, individuals have been required to go to sleep clinics for treatment, but the medical device will allow individuals to be treated at home for a fraction of the cost. Consolidated Research recently finished Food and Drug Administration (“FDA”) trials with a distinguished medical school and has received FDA approval. The client is also in the process of marketing to individual consumers. Cloutier and Lane Powell Counsel to the Firm Barry Abbott helped Consolidated Research prepare a short-term consumer lease that included terms of use for the proprietary intellectual property and patents. The consumer lease was drafted in such a way as to avoid the applicability of  Regulation M (the federal consumer leasing act) and state rent-to-own laws, which was essential for the client to offer the medical device to consumers in a cost-effective manner. Lane Powell Counsel to the Firm Craig Day provided input relating to Health Insurance Portability and Accountability Act issues. The lease was completed in time for Consolidated Research to lease the medical device to its first customers.
