Butler Quoted in Compliance Week Regarding Immigration Compliance Audits

Lane Powell Shareholder Diane Butler was quoted in the March 29 issue of Compliance Week in an article titled “Number of Immigration Compliance Audits Soars.” The article discusses the recent increase in immigration compliance audits and worksite enforcement investigations by U.S. government officials. The Department of Homeland Security’s Immigration and Customs Enforcement (“ICE”) unit announced that 1,000 companies will soon receive a Notice of Inspection — the first step in a Form I-9 audit — to determine if companies are violating U.S. employments laws by hiring illegal workers. Regarding errors in Form I-9, Butler said:

The attestation boxes in Section I — where employees must check off whether they’re claiming to be a U.S. citizen, permanent resident, or someone authorized to work in a country for a particular period of time — ‘seem to cause the most trouble … Employers do not understand the significance of requiring employees to check that box. It seems to be a trap for the unwary.’
